Searchers in major cities within Madison County may check public records through their city’s police department. Huntsville and Madison are two major cities within the county and they each provide instructions on how searchers can request personal and professional background checks.

In Huntsville, background check reports can be requested through the police agency’s Identification Department within the Records Division. This request must be made in person at the police department on Monday through Friday, between the hours of 7 AM and 6 PM (256.427.7128). Inquirers need to have $5-$10 in cash or credit, or issue a check payable to the city.

Those who seek to obtain background check reports through the Huntsville Police Department can make fingerprinting requests with the department. To obtain fingerprints from this department, the request must be for professional purposes or adoption, which depending on the situation can be both a personal and professional purpose.

Inquirers can call 256.427.7128 to set an appointment time, and each fingerprinting card costs $10.

The Madison Police Department’s website contains a link to the Alabama Law Enforcement Agency (ALEA), through which inquirers may execute a background check.10 This is a public background check and individuals can perform a search on themselves or someone else to see if they have a criminal record or to retrieve the disposition of a criminal case.

To complete the ALEA background check, searchers must submit an application to review Alabama criminal history record information.

For this background check, searchers have to obtain blank FBI fingerprint cards from the biometrics section of the FBI’s CJIS Division by calling 304.625.5590 or emailing [email protected]. The fingerprinting can be done at the Madison County Sheriff’s Office.

Moreover, the Alabama Background Check System allows employers to conduct background checks on current or potential employees. The Federal Trade Commission (FTC) requires that employers inform current and prospective employees before running a background check on them. Anyone who falls victim to a background check without receiving the appropriate notice can report the action to the FTC.

Additionally, the Employment Opportunity Commission (EEOC) ensures that employers don’t use these background checks as a means to discriminate when determining who to hire or how to treat their employees. Further, the employer cannot use these checks to retaliate against an employee.

Background checks for personal purposes should not be used to stalk or harass another person. In fact, the State of Alabama has laws against stalking behavior.

How To Utilize State & Federal Resources To Find Alabama Criminal Cases

While Madison County public records will offer a great deal of information on local incidents, broader searches can be conducted through agencies at the state and federal levels.

Searchers can find criminal information via the Alabama Department of Corrections website. This site provides the incarceration details of offenders, and also includes the location of detention within the state, the term imposed for the offense, and the county in which the offense was committed.

Also important is that these results indicate the type of custody under which the offender is spending the sentence.

Additionally, the Alabama Bureau of Pardons and Parole (ABPP) provides parole results of those considered for parole in the current and previous year. The website lists a parole chart that indicates when the parole hearing was held, and in the cases where the parole is denied, if a new hearing date has been reset, it also lists that information.

When parole is granted, the document states the special condition to the parole, such as, ALC, meaning, the parolee must remain alcohol free.

The ABPP also details upcoming parole hearings within the next couple of months and lists the offender’s names and inmate identification number (AIS).

The website also includes information regarding parole hearings that have been canceled. Searchers can also find information regarding pardons.

The State of Alabama also keeps a statewide sex offender registry; concerned individuals can search this online directory by inserting an address to obtain a list of sex offenders in their area.

Further, inquirers can perform searches of possible sex offenders by searching names and they can also search by city, internet names, or email addresses. Moreover, curious parties can search for sex offenders in the state who are non-compliant.

For more searches of sex offenders, searchers can access the national sex offender registry. This national search permits users to search by name as well as by location. There are several courts within Madison County. Some of the courts within the county include the district and circuit courts, family and divorce court, small claims and traffic court.16

The Madison County Circuit Court is the 23rd Judicial Circuit Court of Alabama and this court handles criminal, family, traffic, and civil cases. Inquirers can request records by completing and submitting a records request form.

How To See Marriage, Divorce, Birth & Death Information in Madison County Alabama (Vital Records)

Vital records are records that government agencies maintain to document major life events such as birth, marriage, divorce, and death.

The Madison County Health Department is a local county health department under the Alabama Public Health office and it maintains the access of vital records which allows inquirers to conduct searches such as to find out if someone is married.19

Requests for vital records can be made via mail, in person with the Madison County Health Department, and online via a third party website.

Before attempting to request a copy of these vital records, searchers should be aware of the restrictions on who can access these sensitive documents. In the State of Alabama, marriage and divorce records are accessible to everyone while there are greater restrictions on accessing birth and death records, depending on the date of each event.

Note that when requesting a restricted Alabama vital record, applicants must submit their primary ID or two different forms of identification along with the request form.

If these records are being requested in person and the applicant asks a third party to retrieve the record, both the applicant and the third party must provide acceptable identification before the record is released. Track Down Divorce & Marriage Records Through the Madison County Health Department

While the Health Department is the holder of vital records such as Madison County divorce records as well as marriage records, since 1950, the Alabama Center for Health Statistics has been filing divorce certificates.

If the divorce occurred before 1950, that information can be obtained through the Madison County Circuit Court’s Family Court Division.

The Alabama Center for Health Statistics also files marriage certificates and are a good source to check if someone is married. This center has been filing the certificates since August 1936, and Madison County marriage records for marriages that took place before this date can be made with the Probate Judge.

Divorce and marriage records are accessible to anyone who can pay the $15 fee for a certified copy of the divorce certificate and provide sufficient information for a search to be made. A requester who wants more than one certified copy must pay $6 for each additional copy. If requests are being made via mail, the department only access checks or money orders.

When requesting marriage and divorce records, providing as much information as possible is important to ensuring a successful search. Generally, the requester should know the full name of the parties to the divorce prior to the marriage, the date of the divorce, and the county where the divorce was granted.

Note that this request is not anonymous as the searcher’s name must also be provided in the search, along with a signature, daytime phone number, and address where the certificate should be mailed (if applicable).

On the vital records request form, after filling out the applicant section, which requires stating the applicant’s relationship to the person whose record is being requested and stating the reason for the request.

After completing the applicant portion of the application, searchers must place a check by “DIVORCE” or “MARRIAGE” in the box that appears at the very bottom of the form. Once complete, the applicant can either mail the form along with the check or money order or present the form and payment in person.

For those who cannot appear in person to retrieve the records or would prefer not to mail the request, there is an option to request the certificates online through VitalChek, a third party service provider. After the request is submitted, VitalChek will send a certified copy of the requested certificate via UPS, and there are options for a faster delivery.

Retrieve Madison County Death & Birth Records or Certificates Through the Health Department

The Center for Health statistics has been filing birth and death certificates since 1908 for those who were either born in or died in Alabama. Unlike with the divorce and marriage certificates, there are restrictions on who can access a certificate of death and birth records.

The restriction on access to certificates of birth only applies when the birth occurred less than 125 years from the day it is being requested. Otherwise, there is no restriction. The restricted birth certificates can only be accessed by the person named on the birth certificate, and the named individual’s parents or legal guardian, spouse, children, siblings, and legal representative of an authorized person.

To obtain a death certificate without restriction, the searcher must request the certificate over 25 years from the date of the death.

Otherwise, the death certificate can only be requested by the decedent’s close family members: parents, spouse, children, siblings, grandchildren (if entitlement is demonstrated), legal representative of family or estate, or the person listed to have provided information used on the death certificate.

An applicant of vital records request form used to request a birth or death certificate must render a payment of $15 for a certified copy of either certificate or a “Certificate of Failure to Find,” and any additional copies will cost $6 each.20

If requesting the certificate via mail, the applicant must submit a check or money order payment. Further, accessing these certificates, when restricted, requires that the applicant meet the identification requirements. The back of the form will also list these requirements.

Additionally, knowing as much information as possible regarding the event at issue to ensure that the requested records can be found. For the birth certificate, include the full birth name of the subject of the request, the person’s date of birth, gender (at the time of birth), city or county of the birth, the name of the hospital or whether the birth took place at home, and the full name of the parent before marriage.

The applicant must also provide their name, signature, state the relationship to the search subject, phone number, and provide an address where the certificate can be mailed (if requesting via mail).

The Alabama Public Health Department also provides information on how one can request the birth certificate of those who were adopted.

How To Determine Who Owns a Property or Home in Madison County Alabama at No Cost

Inquirers can find out who owns property via the Madison County Tax Assessor’s free online record search.21

To obtain Madison County public records regarding properties, one can search by the name of the owner or company, the property’s pin, parcel, and account numbers, and the address of the property.

Citizens’ Rights & Responsibilities Regarding Madison County Public Records

When conducting searches in Madison County, requesters should be aware that there are laws governing the intent of the search.

Whether the search is being performed for personal or professional purposes, all searches made utilizing this resource should be in accordance with the federal and state laws.

Through the provisions of the Equal Employment Opportunity Commission, the EEOC is responsible for defending the rights of those subject to employer work discrimination.23

Amongst the acts considered work discrimination includes not having a standard background check process for all employees, but rather, choosing particular employees or prospective employees to be subject to a background check. Further, employers cannot perform a background check on an employee as a means of retaliation.

Additionally, there are also laws against employer discrimination in the State of Alabama.24 Anyone who believes they have been a victim of employer discrimination can file a complaint with the EEOC located at the Birmingham District Attorney’s Office. The complaint can proceed to an investigation if it is filed within 180 calendar days of the incident.

There are also laws that state that employers must inform prospective or current employees when they decide to run a background check on them. The Fair Credit Report Act (FCRA) was instituted to protect parties’ information from unlawful collection, uses, and dissemination. Those who have fallen victim to FCRA violations may file action with the FTC via an online reporting system.

In regard to those searches performed for personal purposes, they are generally legal unless they are being used to stalk or harass another person. There are criminal consequences for stalking and harassing behavior in the state of Alabama.
